达美航空AI服务条款

当您访问和使用生成式AI工具和功能（例如聊天机器人和AI驱动的搜索），以及达美航空公司通过我们的网站和移动应用程序提供的其他技术（统称为“AI工具”）时，本AI服务条款（“AI条款”）适用。本AI条款是您与达美航空有限公司（下称“达美”或“我们”）之间达成的具有法律约束力的协议。By using the AI Tools and the information, content, tools, products and services on our websites and mobile apps (collectively, the “Service” or “Services”), you acknowledge that you have read, understood, and agree to be bound by these AI Terms, the Terms of Use and any other applicable terms and policies.

1. Your Commitments

A. 资格要求

B. 禁止使用的情况

您不得出于以下目的访问、使用或允许他人访问或使用AI工具或服务的任何其他部分：

  • 除非本AI条款和使用条款明确允许，否则不得出于商业或公共目的修改、复制、分发、传输、展示、发布、出售、许可、创建衍生作品，或使用服务或我们的知识产权的任何部分。
  • 在其他网站或网络环境中重新发布、重新分发或构建服务。
  • 反汇编、逆向工程或反编译服务的任何部分。
  • 使用自动化工具（如机器人或抓取程序），以使我们的服务器过载的方式访问服务。
  • 使用服务的内容进行AI训练或识别人员身份。
  • 以影响其稳定性、性能或其他用户的方式使用服务。
  • 采取对我们的基础设施造成不合理负载的行动。
  • 将服务用于非法、欺诈或有害目的。
  • 使用服务与我们竞争或开发竞争产品。
  • 通过未经授权的方式访问服务。

  • 冒充他人或隐藏您的身份。

2. 提示、结果和其他内容

A. Rights to Content

AI工具可能允许您提供用于处理的材料，这些材料可能包括文本、文档、图像或录音，具体取决于集成（统称为“提示”），并根据您的提示生成响应（“输出”）。输出和提示，以及您提供的任何反馈（“反馈信息”）统称为您的“内容”。您不得以任何侵犯或违反他人权利（包括知识产权）的方式提供提示或使用AI工具。除非本AI条款中明确规定，否则您保留对提示的所有权利、所有权和利益，包括任何知识产权。您同意，您提供提示不会违反这些AI条款，包括适用于您使用AI工具的其他政策，我们可能会随时补充、更新或修订这些政策。

达美可能会使用您的内容和相关信息，并可能进行自动或手动（人工）审核以及在某些情况下通过第三方供应商进行此类审核，用于：

  • 提供、维护和改进服务、AI工具以及我们的其他服务和功能，包括用于训练人工智能模型和机器学习算法；
  • 进行并支持研究；
  • 监控您使用我们的AI工具，以确保遵守本AI条款和适用的法律，并根据法律要求报告任何违反适用法律或法规的行为；
  • 删除不安全、歧视性，或其他违反本AI条款或任何其他适用政策和条款的内容；以及
  • 暂停、封锁或删除违反本AI条款的用户或帐户。

B. Personal Information

达美隐私政策规定了我们对通过AI工具收集的个人信息的处理方式，并阐述了我们如何收集、使用和共享个人信息，包括您作为提示、反馈或其他内容提交的个人信息，您在我们的产品活动中提交的个人信息，以及我们从您的设备收集的有关您的设备的个人信息。 

C. 第三方链接

3. 第三方材料

AI工具使用多个来源来回答问题，包括但不限于delta.com、Visa Run Inc.（以“Sherpa”为商号开展业务）和国际航空运输协会（IATA）。Although Delta, Sherpa, and IATA make reasonable efforts to provide accurate information, they cannot guarantee and make no representation or warranties about the accuracy of, and accept no liability for, information about travel restrictions or visa and entry requirements. To the maximum extent permitted by law, Delta is not responsible for any goods or services offered by Sherpa or other providers.

4. 服务的更新和终止

5. AI工具的所有权

6. 免责声明及责任限制

Our AI tools are provided free of charge. To the maximum extent permitted by law, we do not guarantee that the Services or any part or function, including without limitation any transactional function, will be available and not subject to interruption at any time. We may suspend or withdraw or restrict the availability of all or any part of an AI Tool for business and operational reasons. We do not guarantee that any Service or function, including without limitation any downloadable files available on the Delta websites or mobile apps, is free of computer viruses, malware or other destructive or harmful programs, software, code or devices that may erase, scramble, lock or disable any computer software, content or equipment or may prevent users from using a site or any other item of hardware or software. 您应该定期扫描您的系统和下载的文件，以查找此类禁用设备。

AI工具所提供的回复是通过人工生成的，可能存在不准确之处。To the fullest extent permitted by law, Delta: (i) provides the AI Tools on an “AS IS” and “AS AVAILABLE” basis, (ii) does not give any warranties and disclaims all responsibility for any inaccuracies in Outputs and (iii) makes no guarantees that use of the AI Tools will be safe, secure, or error-free, or will function without disruptions, delays, or imperfections. 您不应仅依赖AI工具给出的回复。If the AI Tool is unable to answer your question, the information provided by the AI Tools conflicts with other official information, or you require further assistance, you may contact a Delta Reservations specialist.

AI将根据您提供的提示生成输出。无法提前预测AI工具将根据您的提示返回的特定输出。AI工具可能会生成您认为具有冒犯性或令人反感的内容和/或不代表达美观点的内容。同意本AI条款并使用AI工具，即表示您知悉并承认存在以下风险：您提供的提示可能会导致生成您认为具有冒犯性或令人反感的输出内容。YOU ALSO RECOGNIZE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU – NOT DELTA – ARE RESPONSIBLE FOR YOUR USE OF, AND ANY ACTIONS YOU TAKE IN RELATION TO, OUTPUT GENERATED BY THE AI TOOLS BASED ON YOUR PROMPTS.

责任限制

达美的责任应仅限于适用法律允许的最大范围。在任何情况下，对于因本AI条款或AI工具产生或与之相关的任何利润损失、收入损失、信息或数据损失，或后果性、特殊、间接、惩戒性、惩罚性或附带损害赔偿（无论损害如何造成，也无论基于何种责任理论，包括疏忽责任），我们均不向您承担责任，即使达美航空已被告知存在此类损害的可能性。

免责条款

To the maximum extent permitted by law, you agree to indemnify and hold Delta and its subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from and against any claim or demand, including reasonable attorneys’ fees, due to or arising out of your: (a)使用AI工具；(b)违反本AI条款或任何法律或法规；或(c)侵犯第三方的任何权利。

Jurisdiction-Specific Limitations

Certain jurisdictions do not permit the exclusion of specific warranties or the limitation of certain liabilities. As a result, some provisions outlined in Section 2C (Third Party Links), Section 3 (Third Party Content) and this Section 6 (Disclaimer of Warranties and Limitations on Liability) may not apply to you, and you may be entitled to additional rights under applicable law. In such cases, these AI Terms shall limit Delta’s liability and obligations only to the extent legally permissible in your country of residence.

8. 可分割性

If any portion of these AI Terms is found to be unenforceable, the unenforceable portion will be deemed amended to the minimum extent necessary to make it enforceable, and if it cannot be made enforceable, then it will be severed and the remaining portion will remain in full force and effect unless it is impossible to achieve the purpose of the AI Terms with only the remaining enforceable portions. 若我们未执行本AI条款中的任何规定，并不构成放弃行使。对本AI条款的任何修订或放弃行使，均须以书面形式作出，并由我们签字。
